Legal issue of personal belongings?
My husbands ex got the house in the divorce in 08, but failed to meet her obligations to the court and after a long battle, the house was awarded back to me in March. She refused to leave the house, and we requested a Writ of istance. It was granted and carried out in May. The locks were changed and the troopers stated that anything in the house now belonged to my husband. etc. July 10 he got a phone call from his agent (we live out of state) that she had broken in and was living in the house. She threatened him and he left. We called the state troopers and she was given 24 hours to vacate. Now she is threatening us, threatening our agent at home and at work. She left the house almost 10k behind in mortgage payments which we are having to catch up. Now 4 months after she lost the house in court she is demanding to be allowed to remove her belongings. Do we have to give them back to her or can we sell them to pay off her debts on the mortgage? The troopers will not advise, and the courts are so backlogged they say a response to any motion will take at least 2 months.
